Terms of Service

MyTuff4x4 is a trading name of MB Mechanical Repairs Pty Ltd (ABN 86 149 871 223), Unit 13C, 4 Homepride Ave, Warwick Farm NSW 2170 ("MyTuff4x4", "we", "us", "our").

1. About these Terms

These Terms of Service ("Terms") apply to everyone who uses mytuff4x4.com.au (the "website") or buys from us, including people browsing the website, customers, and anyone who sends us content.

By using the website or placing an order, you agree to these Terms. If you don't agree, please don't use the website or place an order.

Our Refund, Returns and Warranty Policy, Shipping Policy and Privacy Policy also apply, and form part of these Terms.

2. Your rights under the Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or changes any right or remedy you have under the ACL, or under any other law, that cannot lawfully be excluded, restricted or changed. Any part of these Terms that limits what we are responsible for applies only as far as the law allows.

3. Using our website

• By using the website, you confirm that you are at least 18 years old, or that you have a parent's or guardian's permission to use it.
• You must not use the website or our products for any illegal or unauthorised purpose, or break any law when using the website (including copyright law).
• You must not upload or send any virus, malware or other harmful code.
• You must not copy, reproduce, sell, resell or exploit any part of the website or its content without our written permission.
• You must not use the website or its content to: get others to do anything unlawful; break any international, Commonwealth, state, territory or local law; infringe our intellectual property or anyone else's; harass, abuse, insult, harm, defame, intimidate or discriminate against anyone; give false or misleading information; collect or track other people's personal information; spam, phish, scrape or crawl the website; do anything obscene or immoral; or interfere with or get around the website's security features.
• Information you send us (other than payment card details) may pass through various networks, and may be changed to suit their technical requirements. Payment card details are always encrypted when they are sent.
• We may refuse service to anyone at any time for any lawful reason. If you break these Terms, we may suspend or end your use of the website.

4. Information on our website

• We try to keep the information on our website accurate, complete and up to date, but we can't promise it always will be. It is general information only.
• Product details such as fitment, lift heights, specifications and images often come from the manufacturer and can change without notice. If you're not sure a part is suitable for your vehicle, call us on (02) 8747 0325 before you order.
• Colours and images on your screen may look different from the actual product. Some images are for illustration only and may show parts or accessories that aren't included. The product description says what's included.
• Sometimes the website may contain errors, inaccuracies or omissions in product descriptions, prices, promotions, offers, shipping charges, delivery times or stock availability. We may correct them, update the information, or cancel orders affected by them at any time without notice, including after you have placed your order. If we cancel your order because of an error, we will refund what you paid for it in full.
• If the price or description of something in your order was wrong (including an option or add-on that wasn't added to the price), we'll contact you before we send it and tell you what's changed. You can go ahead at the correct price and description, or we'll cancel and refund you in full.
• If we only find a price error after your order has been sent, we'll contact you. You can pay the difference, or send the item back unused and unfitted and we'll refund you in full, including the return freight.
• Except where the law requires, we don't have to update the information on the website.

5. Products, prices and availability

• Prices are in Australian dollars and include GST.
• Prices and product descriptions can change at any time without notice. A price change doesn't affect an order you have already placed, unless the price was an error (see section 4).
• Some products have limited stock. We may limit the quantity of any product we sell, limit sales to any person or region, and discontinue any product at any time.
• We may change, suspend or stop the website (or any part of it) at any time without notice. To the extent permitted by law, we are not liable to you or anyone else for doing so.

6. Orders

• We may refuse any order you place with us. We may limit or cancel quantities bought per person, per household or per order, including orders placed under the same customer account, the same payment card, or the same billing or delivery address. We may also limit or refuse orders that appear to be placed by dealers, resellers or distributors.
• If we change or cancel your order, we will try to contact you using the email address, phone number or address you gave us, and we will refund any payment for the part of the order we cancel.
• You must give us current, complete and accurate details for every order, and keep your account details up to date, so we can complete your order and contact you if we need to.

7. Returns, refunds and warranty

Returns, refunds, warranty claims, order cancellations and parts fitted at our workshop are covered by our Refund, Returns and Warranty Policy. It also explains how to choose the right part, and what applies to suspension, lift kits and GVM upgrades.

If there is a problem with something you bought from us, contact us first (see section 19).

8. Third-party tools

• We may give you access to tools run by third parties, which we don't monitor or control. We provide them "as is" and "as available", without any endorsement. To the extent permitted by law, we are not liable for your use of them. Please read the provider's terms before you use them.
• New features and tools added to the website are also covered by these Terms.

9. Third-party websites

• The website may include content from, or links to, websites run by others, such as manufacturers. We don't control those websites and aren't responsible for their content, products or services. To the extent permitted by law, we are not liable for any loss from your dealings with them. Please read their policies before you buy from them.
• This doesn't apply to products you buy from us. If there is a problem with a product you bought from us, contact us, even if someone else made it.

10. Comments, feedback and other material you send us

• If you send us ideas, suggestions, reviews, photos or other material, whether we asked for it or not, you agree that we may edit, copy, publish, share, translate and otherwise use it in any medium at any time, without restriction. We don't have to keep it confidential, pay for it or reply to it.
• We may, but don't have to, monitor, edit or remove content that we decide is unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's intellectual property or these Terms.
• You agree that what you send us won't breach anyone's rights (including copyright, trade mark, privacy or personality rights), won't contain defamatory, unlawful, abusive or obscene material, and won't contain any virus or malware. You must not use a false email address, pretend to be someone else, or mislead us or anyone else about where your content came from. You are responsible for what you send us and for its accuracy. To the extent permitted by law, we are not responsible for comments posted by you or anyone else.

11. Personal information

Our Privacy Policy explains how we collect, use and handle personal information you give us through the website.

12. Limitation of liability

This section is subject to section 2 (your rights under the Australian Consumer Law).

• We don't promise that the website will always be available, uninterrupted, timely, secure or error-free. We may take it offline for any period, or stop it, at any time without notice.
• To the extent permitted by law, we exclude all terms, conditions and warranties that would otherwise be implied into these Terms, except those that cannot lawfully be excluded, such as the consumer guarantees under the ACL.
• To the extent permitted by law, we (and our directors, employees, agents, contractors, suppliers and service providers) are not liable for any indirect or consequential loss, or for any loss of profit, revenue, savings or data, arising from your use of the website or any product bought through it, whether in contract, tort (including negligence) or otherwise.
• Where the law allows us to limit our liability for a failure to meet a consumer guarantee, our liability is limited, at our option, to: for goods, replacing them, supplying equivalent goods, repairing them, or paying the cost of replacing or repairing them; and for services, supplying them again or paying the cost of having them supplied again.

13. Indemnity

To the extent permitted by law, you agree to indemnify us (and our directors, employees, agents, contractors, suppliers and service providers) against any claim or demand made by someone else, including reasonable legal costs, that arises from your breach of these Terms or of any law, or your infringement of another person's rights. This doesn't apply to the extent the claim was caused by our own breach or negligence.

14. If part of these Terms is invalid

If any part of these Terms is found to be unlawful, void or unenforceable, it will be read down so it is enforceable as far as the law allows. If it can't be read down, that part will be removed, and the rest of these Terms will still apply.

15. Ending these Terms

• These Terms apply until you or we end them. You can end them at any time by telling us you no longer want to use the website, or by stopping using it.
• If we reasonably believe you have broken these Terms, we may end them, or refuse you access to the website (or any part of it), at any time without notice. You will still owe any amounts due up to the date they end.
• Obligations and liabilities that arose before these Terms end continue after they end.

16. Whole agreement

• If we don't enforce a right under these Terms straight away, we haven't given it up.
• These Terms, together with the policies that form part of them, are the agreement between you and us about your use of the website and orders placed through it. They replace any earlier version of these Terms.
• Headings are for convenience only and don't affect the meaning of these Terms.

17. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we agree to the non-exclusive jurisdiction of the courts of New South Wales.

18. Changes to these Terms

• We may update these Terms from time to time by posting the new version on this page. Please check this page regularly.
• The Terms in place when you place an order apply to that order. If you keep using the website after a change is posted, the updated Terms apply to that use.
